Terms and Conditions

You are purchasing registration or a license for single-use of one Smartsims simulation for a period of up to six months from the date of purchase. Licenses are not transferrable to a different user, course or semester than displayed on your invoice.

To the full extent permitted by the Commonwealth, State, Territory or other law or laws applicable to this Agreement, any conditions or warranties imposed by such legislation are hereby excluded. Insofar as liability under or pursuant to any legislation, whether of Commonwealth, State, Territory or other government, may not be excluded, such liability is limited to:

(i) replacement of the software / online simulation, or
(ii) correction of defects in the software / online simulation at the exclusive option of Smartsims International Limited/Smartsims Inc.

You acknowledge that no promise, representation or warranty or undertaking has been made or given by Smartsims International Limited/Smartsims Inc. or any person or company on its behalf in relation to the profitability of or any other consequences or benefits to be obtained from the delivery or use of the software / online simulation and any accompanying Smartsims International Limited/Smartsims Inc. supplied manuals, and support materials, whether in hardcopy or electronic form for use by you. This Agreement constitutes the entire agreement and understanding between you and Smartsims International Limited/Smartsims Inc. in relation to the supply of the software / online simulation and any accompanying manuals and written materials from Smartsims International Limited/Smartsims Inc.

Except as and to the extent that it is hereinbefore provided, under no circumstances shall Smartsims International Limited/Smartsims Inc. or any related company be liable for any loss, damage or injury (including without limitation any loss of profit, indirect, consequential or incidental loss, damage or injury) arising from the supply or use of the SOFTWARE and any accompanying hardware and written materials or any failure by Smartsims International Limited/Smartsims Inc. or any related company to perform any obligation or observe any terms of this Agreement.

PRIVACY POLICY CONSENT

I consent to Smartsims International Ltd / Smartsims Inc. using the personal information I have provided, and/or my school has provided, but only in the provision of the business simulation product and related services purchased.

I authorize Smartsims International Ltd / Smartsims Inc. to contact me with information relating to the business simulation product and related services purchased.

I agree that Smartsims International Ltd / Smartsims Inc. may need to share my information with course faculty, my team members, their credit card processing provider, government departments, or for reporting requirements.

REFUND POLICY

For payments made directly to Smartsims International Limited/Smartsims Inc by credit card through the Smartsims website (www.smartsims.com), refunds will only be processed in the following circumstance:

Where your enrollment in the associated course is officially cancelled within 14 days of the course’s start date AND you notify Smartsims within seven days of cancellation. Proof of official course cancellation is required.

Refunds for Prepaid Access Codes cannot be processed by Smartsims International Limited/Smartsims Inc, rather must be made at the original point of purchase.

We reserve the right to make updates to these terms, conditions and policies from time to time. All changes will be published on this page.
