You are purchasing registration or a license for single-use of one Smartsims simulation for a period of up to six months from the date of purchase. Licenses are not transferrable to a different user, course or semester than displayed on your invoice.
Personal Information Collection Notice
We are collecting your personal information (Name and Email address) to manage your use of a Smartsims Business simulation. If you have questions about our collection of your information, please contact us at help@smartsims.com.
IF you are paying for the use of the simulation with a credit card, you will be redirected to our Payment Gateway Provider to provide your billing information. The details you provide to the Payment Gateway will include your credit card information and may include other contact information such as your billing address. This will be used by the Payment Gateway to process the credit card transaction, and Smartsims will be notified on completion of a successful transaction. Smartsims does not collect this billing information.
The Payment Gateway Provider is a subsidiary of VISA, maintains PCI DSS 4.0 Compliance, and is audited annually for compliance with SSAE-18 / SOC-1. This requires the Payment Gateway Provider to maintain a range of technical and procedural measures to ensure the security of the personal / billing information that you provide to them.
For customers in British Columbia in Canada, we are collecting your personal information under sections 26(c) and / or 26(d) of the Freedom of Information and Protection of Privacy Act.
Privacy Policy and Consent to use Personal Information
I consent to Smartsims International Ltd / Smartsims Inc. using the personal information I have provided, and/or my school has provided, but only in the provision of the business simulation product and related services purchased.
I authorize Smartsims International Ltd / Smartsims Inc. to contact me with information relating to the business simulation product and related services purchased.
If I pay for my use of the simulation by credit card, then I agree that the Payment Gateway Provider may use any personal information that I provide to them in the provision of the credit card transaction.
I agree that Smartsims International Ltd / Smartsims Inc. may need to share my information with course faculty and my team members in the provision of the simulation and related services.
I agree that Smartsims International Ltd / Smartsims Inc. may need to share my information if necessary to comply with any legal, legislative, or statutory requirements.

Refund Policy
For payments made directly to Smartsims International Limited/Smartsims Inc by credit card through the Payment Gateway, refunds will only be processed in the following circumstance:
Where your enrollment in the associated course is officially cancelled within 14 days of the course’s start date AND you notify Smartsims within seven days of cancellation. Proof of official course cancellation is required.
Refunds for Prepaid Access Codes cannot be processed by Smartsims International Limited/Smartsims Inc, rather must be made at the original point of purchase.
Limited Warranty and Limitation of Liability
To the full extent permitted by the Commonwealth, State, Territory or other law or laws applicable to this Agreement, any conditions or warranties imposed by such legislation are hereby excluded. Insofar as liability under or pursuant to any legislation, whether of Commonwealth, State, Territory or other government, may not be excluded, such liability is limited to:
(i) replacement of the software / online simulation, or
(ii) correction of defects in the software / online simulation at the exclusive option of Smartsims International Limited/Smartsims Inc.
You acknowledge that no promise, representation or warranty or undertaking has been made or given by Smartsims International Limited/Smartsims Inc. or any person or company on its behalf in relation to the profitability of or any other consequences or benefits to be obtained from the delivery or use of the software / online simulation and any accompanying Smartsims International Limited/Smartsims Inc. supplied manuals, and support materials, whether in hardcopy or electronic form for use by you. This Agreement constitutes the entire agreement and understanding between you and Smartsims International Limited/Smartsims Inc. in relation to the supply of the software / online simulation and any accompanying manuals and written materials from Smartsims International Limited/Smartsims Inc.
Except as and to the extent that it is hereinbefore provided, under no circumstances shall Smartsims International Limited/Smartsims Inc. or any related company be liable for any loss, damage or injury (including without limitation any loss of profit, indirect, consequential or incidental loss, damage or injury) arising from the supply or use of the SOFTWARE and any accompanying hardware and written materials or any failure by Smartsims International Limited/Smartsims Inc. or any related company to perform any obligation or observe any terms of this Agreement.
Acceptable Use Policy
I agree that I will use the Simulation for learning purposes as part of my own academic study or Professional development.
I agree I will not post any harmful or offensive content in the simulation system.
I agree that I will not attempt to cheat, gain an unfair advantage, or otherwise encourage others to cheat or gain an unfair advantage in any course of study or assessments related to the simulation.
I agree I will comply with any applicable academic integrity rules when using the simulation as part of a course of study.
I understand that any breaches of this Acceptable Use Policy may be reported to my instructor, which may have further consequences under the academic integrity rules of my institution.
You may not attempt to gain unauthorized access to the simulation system, nor permit or assist others to gain unauthorized access to the simulation system.
You may not attempt to cause harm to the simulation system, nor permit or assist others to cause harm to the simulation system.
This is is not an exhaustive list of acceptable / unacceptable practices. If you engage in any behavior that in the sole opinion of Smartsims International Ltd / Smartsims Inc is inconsistent with commonly accepted study practices, or which is damaging to the simulation system, then you may be in breach of this Acceptable Use Policy.
Termination of Agreement
If, in the sole opinion of Smartsims International Limited/Smartsims Inc., you violate the Acceptable Use Policy, or help others to do so, then Smartsims may suspend or terminate your access to the simulation and any associated services.
We reserve the right to make updates to these terms, conditions and policies from time to time. All changes will be published on this page.
